Allegations Of Waste, Fraud
and Abuse
Jonathan M. Fishbein, M.D. has provided
federal investigators with evidence of widespread
scientific and professional misconduct at
the National Institutes of Health (NIH),
the National Institute of Allergy and Infectious
Disease (NIAID) and its Division of AIDS
(DAIDS). This evidence supports 19 principal
allegations* against both the Agency and
individuals working for the Agency.
- Bid rigging,
- Failure to disclose waste, fraud and
abuse in government,
- Unlawful withholding of government
information that has been requested under
the Freedom of Information and Privacy
Acts,
- Inducement to commit fraud against
the U.S. Government,
- Violations of the Whistleblower Protection
Act,
- Making false statements in a government
matter,
- Sexual harassment,
- Improper use of a government CIT Enterprise
System,
- Harassing and intimidation of employees
who raise health and safety concerns,
- Failure to report possible criminal
violations,
- Failure of officials to investigate
documented allegations of wrongdoing,
- Scientific Misconduct,
- Misuse of the government personnel system,
- Failure to follow or enforce Good Clinical
Practices in AIDS trials,
- Improperly rewriting critical health
and safety reports,
- Failure to disclose information relating
to the wrongful death of a patient on
a clinical trial,
- Failure to disclose audit reports to
appropriate authorities including the
White House,
- Implementing a double standard regarding
the quality of clinical trial practices
– one standard for Africa and a
higher standard for the U.S., and
- Ignoring health and safety data prior
to approving the distribution of drugs
for treatment of persons with AIDS.
